These Terms of Service (“Terms”) govern your use of www.savethedayrestoration.com and all services provided by Save The Day Restoration & Reconstruction, a locally-owned California-licensed contractor (License #1049188), IICRC Certified Firm, located at 2424 Gundry Ave, Signal Hill, CA 90755. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Acceptance of Terms
By accessing or using www.savethedayrestoration.com, submitting a contact form, calling our office, or engaging our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These Terms apply to all visitors, clients, and anyone who accesses or uses our website and services. If you are entering into a service agreement on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.
Services Description
Restoration Services
Save The Day Restoration & Reconstruction provides comprehensive disaster restoration and general contracting services, including water damage restoration (water extraction, structural drying, dehumidification, moisture mapping), fire and smoke damage restoration (soot removal, smoke odor elimination, structural cleaning, content restoration), mold remediation (testing, containment, removal, post-remediation verification), sewage cleanup and biohazard remediation, emergency board-up and tarping services, content pack-out, cleaning, and storage, asbestos testing and abatement, professional equipment rental, and full reconstruction and general contracting (framing, drywall, flooring, painting, cabinetry, roofing, plumbing, electrical). All work is performed under California Contractor License #1049188 by IICRC-certified technicians following industry-standard protocols.
Service Area
We serve all of Los Angeles County and Orange County, covering 47 cities across two counties. Our headquarters is located at 2424 Gundry Ave, Signal Hill, CA 90755. We do not limit our service area to specific cities. If your property is located anywhere in LA or Orange County, we will respond.
Emergency Services
Our emergency line at (562) 246-9908 is staffed 24 hours a day, 7 days a week, 365 days a year. For urgent situations including active water leaks, fire damage, sewage backups, and storm damage, we dispatch crews as quickly as possible. Emergency mitigation work may begin before a formal written estimate is prepared when immediate action is necessary to prevent further property damage, in accordance with California Civil Code and IICRC S500/S520/S540 standards.
Estimates and Pricing
Assessments
Save The Day Restoration & Reconstruction does not offer free inspections. To discuss your restoration or reconstruction needs, call our 24/7 line at (562) 246-9908 and our team will schedule an assessment at your property. Assessments are conducted by IICRC-certified technicians who evaluate damage, identify the scope of work, and prepare a detailed estimate.
Insurance Pricing
For insurance-covered work, we use Xactimate software to prepare estimates. Xactimate is the industry-standard estimating platform used by insurance adjusters nationwide. This standardized pricing ensures transparency and alignment between our estimates and your insurance carrier's expectations. Xactimate pricing is based on local market rates for materials and labor in the Los Angeles and Orange County area.
Price Adjustments
Restoration and reconstruction projects may uncover hidden damage that was not visible or detectable during the initial assessment. This is common in water damage (hidden moisture behind walls), fire damage (structural damage concealed by soot), and mold (growth behind building materials). When additional damage is discovered, we will document the findings, notify you and your insurance carrier, prepare a supplemental estimate for the additional work, and obtain your written approval before proceeding with the expanded scope. Change orders for client-requested modifications outside the original scope of work will be documented in writing with associated costs before work begins.
Scheduling and Access
Property Access Requirements
To perform restoration and reconstruction services, we require reasonable access to the affected property. You agree to provide safe and clear access to all areas requiring service, authorize our team and any necessary subcontractors to enter the property during agreed-upon hours, remove or secure personal belongings and valuables from work areas when possible, ensure that pets are secured or removed from active work zones, and maintain utility services (electricity, water) as needed for equipment operation unless utilities pose a safety hazard.
Cancellation Policy
If you need to cancel or reschedule a non-emergency service appointment, we request at least 24 hours' notice. Emergency services that have already been dispatched or initiated cannot be cancelled without responsibility for costs incurred up to the point of cancellation, including mobilization, labor, and materials.
Project Delays
We strive to complete all projects within the estimated timeline. However, delays may occur due to factors beyond our control, including adverse weather conditions, material supply chain disruptions, permit processing times by local building departments, insurance approval or supplement review timelines, discovery of additional damage during the course of work, required third-party inspections or testing, and hazardous material findings that require specialized protocols. We will communicate any delays promptly and work to minimize their impact on your project timeline.
Payment Terms
Payment Methods
We accept payment by check, credit card, debit card, and direct bank transfer. Payment terms are outlined in your individual project agreement or estimate.
Insurance Direct Billing
When you authorize us to work with your insurance carrier, we bill the carrier directly for covered work. This includes submitting Xactimate estimates, supporting documentation, photographs, and moisture logs. We handle carrier communications, supplement requests, and payment processing. Direct billing is a convenience we offer to reduce your out-of-pocket burden during a stressful time.
Homeowner Responsibility
Even when insurance covers restoration work, you remain responsible for your insurance deductible, which is payable to Save The Day Restoration & Reconstruction, any work not covered by your insurance policy, any work you authorize that falls outside the insurance claim scope, and final payment of any balance remaining after insurance proceeds are applied. We will clearly communicate your financial responsibility before work begins.
Late Payment
Invoices are due upon receipt unless other terms are specified in your project agreement. Past-due balances may be subject to a late fee of 1.5% per month (18% per annum) or the maximum rate permitted by California law, whichever is less. We reserve the right to suspend work on active projects with past-due balances and to file a mechanic's lien on the property in accordance with California Civil Code.
Warranties and Guarantees
Workmanship Warranty
Save The Day Restoration & Reconstruction stands behind the quality of our work. Specific warranty terms, duration, and coverage are provided in writing with your project agreement. Workmanship warranties cover defects in labor and installation performed by our team. Warranty claims must be reported promptly upon discovery.
Material Warranties
Materials used in your project may carry manufacturer warranties that are separate from our workmanship warranty. We will pass through all applicable manufacturer warranties and provide you with relevant documentation. Manufacturer warranty claims are handled directly with the manufacturer, though we will assist you in initiating claims when possible.
Limitations
Warranties do not cover damage caused by events occurring after project completion (new water intrusion, fire, natural disasters), normal wear and tear, pre-existing conditions not included in the original scope of work, modifications or repairs made by others after our work is complete, failure to follow post-restoration care instructions provided by our team, or use of the property or materials in a manner inconsistent with their intended purpose.
Limitation of Liability
Pre-Existing Conditions
Save The Day Restoration & Reconstruction is not liable for pre-existing damage, defects, or conditions at your property that were not caused by the event we are addressing. During our assessment, we document existing conditions to the extent possible. However, some pre-existing conditions may not be detectable until work is underway. We will notify you of any pre-existing conditions discovered during the project.
Maximum Liability
To the maximum extent permitted by California law, the total liability of Save The Day Restoration & Reconstruction for any claim arising from our services shall not exceed the total amount paid by you (or your insurance carrier on your behalf) for the specific services giving rise to the claim.
Consequential Damages Exclusion
In no event shall Save The Day Restoration & Reconstruction be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use of property, lost profits, loss of business opportunity, or emotional distress, regardless of the cause of action or the theory of liability, even if we have been advised of the possibility of such damages.
Insurance Claims Assistance
Our Role
As a courtesy to our clients, Save The Day Restoration & Reconstruction provides insurance claims assistance. This includes documenting property damage with detailed photographs, moisture readings, and thermal imaging, preparing Xactimate estimates in the format insurance carriers require, communicating directly with your insurance adjuster regarding scope of work, submitting supplements when additional damage is discovered, and providing progress documentation throughout the project. We are not public adjusters, insurance agents, or attorneys. Our claims assistance is part of our restoration service and does not constitute insurance advice or legal representation.
Homeowner Responsibilities
When working with insurance, you are responsible for promptly reporting the loss to your insurance carrier, providing accurate information about the damage and its cause, cooperating with your insurance carrier's investigation and adjuster inspections, reviewing and signing claim-related documents, paying your deductible, and communicating any carrier concerns or disputes to our team promptly.
Disclaimer
Save The Day Restoration & Reconstruction does not guarantee the outcome of any insurance claim. Claim approval, coverage determinations, and payment amounts are solely at the discretion of your insurance carrier. We cannot control or influence your carrier's coverage decisions. If your claim is partially or fully denied, you remain responsible for the cost of services rendered.
Property and Contents
Content Pack-Out and Storage
When restoration work requires the removal of personal property, we provide professional content pack-out services. All items are inventoried, documented with photographs, carefully packed, and transported to our secure storage facility. We maintain detailed records of all packed items and their condition. Contents are stored securely and returned upon completion of restoration work. Storage beyond the project timeline may incur additional charges, which will be communicated in advance.
Damage Discovery During Work
During the course of restoration or reconstruction, our team may discover damage that was not visible or detectable during the initial assessment. This includes hidden mold behind walls or under flooring, structural damage concealed by finish materials, water damage in areas not initially affected, deteriorated plumbing, wiring, or other building systems, and pest or termite damage. When such conditions are discovered, we will stop work in the affected area, document the findings, notify you and your insurance carrier, prepare a supplemental scope and estimate, and await your authorization before proceeding.
Hazardous Materials
Properties built before 1980 may contain hazardous materials including asbestos, lead-based paint, and other regulated substances. If hazardous materials are discovered or suspected during our work, we are required by federal and California law to follow specific protocols. This may include stopping work in the affected area, engaging certified hazardous material abatement professionals, testing suspect materials at a certified laboratory, following all EPA, Cal/OSHA, and AQMD regulations, and providing required notifications to occupants and authorities. Hazardous material abatement is typically a separate scope of work with additional costs. We will communicate all findings and costs before proceeding.

Photos and Documentation
During the course of restoration and reconstruction projects, Save The Day Restoration & Reconstruction photographs work in progress and completed projects for documentation, quality assurance, insurance purposes, and portfolio use. By engaging our services, you acknowledge that we may use anonymized project photographs (without identifying information about you or your specific property address) in our marketing materials, website, and social media. If you object to the use of project photographs, please notify us in writing before work begins.
User Conduct
Acceptable Use
When using our website, you agree to use the site only for lawful purposes, provide accurate and truthful information in all forms and communications, respect the intellectual property rights of Save The Day Restoration & Reconstruction and third parties, and refrain from any activity that could harm, disable, or impair our website's functionality.

Dispute Resolution
Governing Law
These Terms and any disputes arising from them or our services are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
Mediation First
Before initiating any legal proceeding, both parties agree to attempt to resolve disputes through good-faith mediation. Either party may initiate mediation by providing written notice to the other party. Mediation shall be conducted in Los Angeles County, California, by a mutually agreed-upon mediator. If the parties cannot agree on a mediator within 14 days, either party may request the Los Angeles County Superior Court to appoint one. Each party shall bear its own mediation costs, and shared costs shall be split equally.
Arbitration
If mediation does not resolve the dispute within 60 days, either party may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Los Angeles County, California. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Claims for injunctive relief or intellectual property disputes are exempt from mandatory arbitration.
Jurisdiction
For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California. You waive any objection to venue in these courts.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms of Service, together with our Privacy Policy and any written project agreements, estimates, or change orders, constitute the entire agreement between you and Save The Day Restoration & Reconstruction regarding your use of our website and services. These Terms supersede all prior or contemporaneous communications, proposals, and representations, whether oral or written, regarding the subject matter herein. In the event of a conflict between these Terms and a specific project agreement, the project agreement shall control with respect to the services covered by that agreement.
Changes to Terms
Save The Day Restoration & Reconstruction reserves the right to modify these Terms of Service at any time. Changes become effective immediately upon posting to this page. We will update the "Effective Date" at the top of this page when changes are made. Material changes may be communicated via email or a prominent notice on our website. Your continued use of our website or services after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.
